In a significant victory for the AAP, MP Sanjay Singh was granted bail by the Supreme Court in the Delhi Liquor Policy case. However, the Supreme Court ruled that Singh’s compromise could not set a precedent.
The Supreme Court on Tuesday granted bail to MP Sanjay Singh in the Delhi Liquor Policy case, marking a significant victory for the Aam Aadmi Party (AAP). Nonetheless, the Supreme Court ruled that Singh’s compromise could not set a precedent for others.
Sanjay Singh must be released on terms and conditions that the trial court may decide upon in light of the statement provided by the Enforcement Directorate (ED), according to a bench led by Justice Sanjiv Khanna. Singh was permitted by the court to engage in political activity as well.
“Concession cannot be used as a rule of thumb. Sanjay Singh is permitted to carry on with his political endeavors.” The bench gave a clear command.
Before going to lunch, Justice Khanna gave ASG Raju instructions to receive word from the ED by 2:00 PM regarding whether Singh needed to be locked up again.
Singh has been in detention for six months, and Justice Khanna has informed the ED that no money has been found and that there is no trace. “You argue on merits, if we feel instructions are required, we will list on Tuesday.”
The ED informed the Supreme Court today that it had no issues with Sanjay Singh being granted bail.
Abhishek Manu Singhvi claims that the ED launched a vendetta against Sanjay Singh
In support of Singh, Senior Advocate Abhishek Manu Singhvi delivered a number of stinging arguments against the ED’s case. He stated that following Singh’s press conference, the ED began a personal vendetta, and that’s why the agency officers visited his home immediately thereafter.
The statements of approver Dinesh Arora are the foundation of the entire ED case against Singh, Singhvi said the court. He cited the Supreme Court as evidence that, prior to naming Singh, Arora had actually made nine remarks that exonerated him.
He added that Arora was given bail based on the ED’s “no-objection.” And he afterwards became an approver in case the approver’s words could not be trusted. Singhvi said that this no-objection was granted in order to receive the Section 50 statement that Arora subsequently provided, which named Singh.
Sanjay Singh’s Allegations Made by the ED
Sanjay Singh is accused by the ED of being a “key conspirator” in the purported Delhi Liquor Policy scam and of having a close relationship with Amit and Dinesh Arora, who are also charged in the scam.
In response to Sanjay Singh’s bail request in the Delhi High Court, the Enforcement Department stated that Singh had a hand in setting up M/s Aralias Hospitality Pvt Ltd as a special purpose vehicle to launder the “proceeds of crime” that would have been produced by the business that resulted from the Delhi liquor policy.
Singh is charged with obtaining, possessing, hiding, distributing, and exploiting the proceeds of crime produced by the purported flaws in the Delhi liquor legislation, which has since been abandoned. Therefore, the ED claims that AAP leaders colluded to create the new excise policy so they could profit from bribes from producers and wholesalers of booze.
During the search of Singh’s property on October 4, 2023, ED claimed discovered “confidential documents” connected to the probe of the Delhi Liquor Policy case. After these raids, he was taken into custody by the central agency.
